AM Constitution

(AMC)

1. Foundations of Henuldia (referred to as the "RAIS" in this document)

​

1. The RAIS shall be a constitutional stratocratic-technocratic state. Do understand that the use of the word “civil” in any RAIS-related documents either refers to a stratocracy’s equivalent of “civil” or off-duty/reserve RDC personnel, and whatever is (traditionally) defined as “civil” may only “civil” in text as all RAISian citizens are technically military personnel.

 

2. The RAIS shall function mostly as a “ceremonial” state. However, it shall still be treated as a legitimate micronation, similar to other more successful micronations, such as the Republic of Molossia and the Principality of Sealand. Additionally, by decree, the RAIS officially recognizes the simulationist nation “Tolmakia” as its predecessor.

 

3. The RAIS shall have its founder, AM, as its first President-Chief (PC). The PC will have the authority to hold elections or appoint a successor. As of 2024, the role of PC has been succeeded by the Plinmnuszig as Admin, which shall serve in its place from this year onwards.

 

4. The government of the RAIS shall be structured into 3 primary parts: the Executive Offices and Departments (EOD), which shall include the cabinet; the Plinmuszig (parliament); and the Military Departments (the military forces and their branches). The Supreme Court of the RAIS (judiciary) shall be a shared branch between the EOD’s Ministry of Law Affairs and the Plinmuszig’ Judicial Board. Do understand that the non-Military Departments are to be considered military personnel in non-military duties, while Military Departments may also be referred to officially as security departments.

 

5. The RAIS Defence Corps (RDC) of the security departments shall serve as the RAIS’ military forces, and comprise of the RAISian Defence Corps land components, the RAISian Air Force, and the AM Intelligence Agency (also the special forces). The military forces shall be designated a self-defence force, accordingly to state ideology. Furthermore, during peacetime, the RAIS Defence Corps shall be recognized as a militia unit, fit for carrying out both “civil” and military duties.

 

6. The government will act to meet the welfare and contentedness of both its people (in order for them to be productive and in sound state) and itself (in order to be able carry out its duties) in the name of peace and (scientific and social) progress. In turn, the people must comply to government policies and uphold the interests of the state, but also know their rights and their positions, with the right to maintain the existence of the state should the executive government collapse (i.e. dissolve).

 

Note that due to the size and conditions of this state, the line between the government and the people is quite thin, and thus the interests of the government and the people are expected to be aligned. The LYM values will also be acknowledged here.

 

7. State-sanctioned ideologies are stratocracy, technocracy, moderation, and non-interventionism. Unless directly provoked or assaulted, the RAIS shall declare neutrality in all armed conflicts. The state economy shall follow a mixed system, with a capitalistic method of conducting business and a socialist method of distributing state-owned assets when deemed necessary. The state shall impost no religion.

 

8. The RAIS’ national language shall be Henuldian, while other official languages shall be Danish, English, and Tagalog. Henuldian usage shall be strictly enforced on RAISian documents, property, and territory.

 

9. National state symbols found within the borders of the RAIS shall be respected. The anthem and oath of allegiance shall be held sacrosanct in sincerity.

 

10. From June 10, 2017 onwards, the territory of the RAIS shall comprise of AM’s room, and stretch from its very walls to the first “plank” outside of the RAIS. Note that the term “RAISian borders” also includes the extent of the applicability of RAISian law and jurisdiction over any territory it maintains a presence on but does not claim.

2. Presidential Decrees of the RAIS

​

Decree #1 (6/10/17) – Creation of the RAIS

The RAIS is declared a micronation on June 10, 2017, with its own constitution outlining its government, law, armed forces, and other aspects of its existence.

The RAIS recognizes some elements of the AMCG as valid and relevant, and as the spiritual predecessor of the AMC.

The RAIS recognizes “Arise once more” as its de facto national anthem, if for some reason the legitimate national anthem cannot be played.

Decree #4 (9/28/17) – Definition and recognition of Tolmakia

The RAIS defines Tolmakia as a fictional virtual nation-state (termed a “simulationist nation” as of 2019), and its official predecessor. Its name, uniforms, flag, and history shall remain to be refrained upon from, however, unless in proper context.

Decree #5 (10/01/17) – RAISian National Archives status

The RAISian national archives shall be held in the same status as the Henuldian language: privy only to RAISian citizens.

Decree #6 (9/22/18) – Gas Gun Ban

Gas Guns, specifically those using a flammable propellant, shall be banned in the RAIS. Airguns are notably not to be considered as such, and will still be legal within the state’s premises.

3. Basic Rights (Human and Legal) of the RAIS

​

1. Freedom of Speech

Individuals are entitled to one’s own opinions and statements. However, the constitution encourages individuals to refrain from abusing this basic right, especially if to discredit or harm others for personal gain, to intentionally or unintentionally spread misinformation and deceive, or cause any wanton destruction in any form via this basic right.

 

2. Freedom of Ideology

Individuals have the right to adhere to their own ideologies, as long as their ideologies comply with the constitution and do not contradict with the values of RAISian society or disrupt its affairs. Propaganda is legal but must be regulated accordingly to the first basic right, other people’s ideologies must be respected, and persecuting people with different ideologies (especially with the intent of promoting one’s ideology) is illegal and may be punished with deportation.

 

3. Freedom of Religion

Individuals are entitled to practice their religion within RAIS borders, as long as their religions comply with the constitution and compromise as needed to integrate within RAISian society and maintain peace and harmony with other religions or beliefs in the republic. Violent and unrestrained extremists are BANNED from the RAIS, and religious communities or structures will need to submit a letter or application to the RAISian government for an approval to exist in the republic.

 

4. Freedom of Society

Society has the right to form their own norms and standards to conform to, as long as they do not breach the constitution. It decides on matters the government deems are for the public, such as LGBTQ rights, social justice, and etc., as long as social pressure is not the basis for such norms and standards, and individuals retain the right to their own identity as much as they have a right to be part of society. Censorship and taboo topics are regulated according to what most of society deems acceptable unless the RAISian government declares otherwise in rare and special cases.

 

5. Right to Welfare

Individuals within RAIS grounds are entitled to government protection, including from security threats, natural calamities, legal issues (the right to a trial), or health problems (including mental sicknesses). As technical military personnel, RAISians may request weapons from the state arsenal for self-defence, request assistance from the government in times of disaster or legal trouble, or request leave to attend to their medical health problems. Non-RAISians are entitled to temporary assistance, advice from the government, and (if within RAISian borders or jurisdiction, especially in the case of VIPs for the latter) security.

 

6. Right to Privacy

Individuals have the right to privacy, and both the government and the people are expected to respect each other’s privacy, as well as uphold the protection of individual privacy. This means no internet surveillance, the right to retain one’s own sensitive information, and the “right to silence.” However, criminals guilty of at least one felony may lose this right, particularly those who abuse its privilege for their own gains and to the detriment of others. Those who violate this law may be deported and banned from the RAIS.

 

7. Right to Personal Defence

Individuals have the right to personal defence, as long as they do not override or compromise government protection or the personal defence and safety of others. RAISians have the right to weaponry to defend themselves, and may own at least one melee weapon and one ranged weapon, unless they are in the active military or are recognized weapon dealers (RAISian citizenship requires open carry weapon permits). Concealed weaponry is also legal as long as they are presented or declared at security checkpoints with the proper documents.

 

The right to personal defence also includes the control of access to one’s confidential personal information, data, and contact details by others. Individuals have the right to retain personal information as long as they do not breach the constitution.

4. Penal Code of the RAIS

​

The penal code of the RAIS shall apply equally to citizens, government officials, and visitors in the RAIS, regardless of race, gender, or occupation. All individuals have the right to a trial. If a RAISian is given an indefinite ban, his or her citizenship is revoked indefinitely.

 

I. Misdemeanors

1. No illegal drugs

Drugs classified by the Republic of the Philippines as illegal shall also be illegal in the RAIS.

 

Punishment: 2 official warnings, and confiscation and disposal of drugs; deportation for third offence; deportation and 1 month ban for fourth offence; indefinite ban for further attempts.

 

2. No smoking

Cigars and cigarettes, as well as other substances (such as hallucinogens, chemicals, and etc.) that can be smoked are banned in the RAIS. Vapes are exempted from this smoking ban.

 

Punishment: 2 official warnings, and confiscation and disposal of smokes; deportation for third offence; deportation and 1 month ban for fourth offence; indefinite ban for further attempts.

​

3. No trespassing

Entities without any permit or approved reason to enter the RAIS shall not be permitted entry. The right to entry may also be revoked to guests without announcement.

​

Punishment: 2 official warnings and possible deportation; a nasty pout and attitude for third offence; deportation and 1 month ban for fourth offence; indefinite ban for further attempts.

​

4. No stealing

Thievery shall not be tolerated in the RAIS. This law applies to acts of thievery ranging from shoplifting to stealing from government coffers.

 

Punishment: 2 warnings and re-acquirement/replacement of stolen valuables; deportation for third offence; deportation and 1 month ban for fourth offence; indefinite ban for further attempts.

5. No plagiarism and data theft

Directly copying works, important data (such as research information), or even identities of others without any original changes or artistic modifications, and with the intention of passing off such copied works or data as one’s own or for earning money is illegal in the RAIS.

​

Punishment: 3 official warnings; deportation and 1 month ban for fourth offence; deportation and indefinite ban for further attempts.

​

6. No desecration of national symbols and items

Individuals within the RAIS are expected to respect the national symbols, including the flag, the coat of arms, and national artifacts as these are also owned by the state, and thus are state assets. The desecration of any state-owned asset within RAISian jurisdiction is punishable.

 

As part of the constitution’s basic rights, individuals may still express themselves by flag burning or parodying national symbols and items, but only if individuals bring or create their own copies of national items or symbols and for good reason (i.e. political demonstration for a just cause). Furthermore, minor parodying of national symbols and items such as making memes out of them is acceptable in most circumstances as long as the actual state-owned assets are not physically defaced.

 

In the case of the national mascot Uni, any individual physically within Henuldian territory caught lewding her (and thereby desecrating her as one of the RAIS' symbols) shall be punished accordingly under this item as well.

 

Punishment: 2 official warnings; immediate deportation and 1 month ban for third offence; deportation and indefinite ban for further attempts.

​

II. Felonies

The death penalty does not exist in the RAIS, instead replaced in its stead by a lifetime ban. However, individuals in the act of committing some felonies may be put to death as a result of self-defence by any RAISian or even visitor. In the case that an act is covered by both a felony and a misdemeanor, their punishments will be modified accordingly or the felony’s punishments will overrule that of the misdemeanor’s. Additionally, immediate deportation and an indefinite ban will be rewarded to offenders of more than 3 demeanors (if they are not indefinitely banned yet) or 1 to 2 felonies.

 

1. No violation or abuse of basic (human and legal) rights

The disregard for, or lack of moderation in practicing/respecting any of the basic rights defined above will result in assured punishment.

 

Punishment: unless the violation include factors that warrant it to be classified as a felony, the offender will: face an official warning; deportation for second offence; deportation and indefinite ban for further offenses. Harassment (including verbal death threats) will also be responded to with these punishments, as protection from harassment (not to mention, protection from persecution) falls under the right to welfare.

 

2. No murder

One whose actions directly result in the death of another individual will immediately be detained and punished.

​

Punishment: immediate deportation, extradition to the Philippine government, and lifetime ban. For accidental homicides, immediate deportation and extradition to the Philippine government.

​

3. No sexual harassment and rape

One who initiates or engages in sexual activity with another individual without their consent shall be deemed a sex offender and subjected to punishment. Age of consent shall be 18 and above.

 

Punishment: immediate deportation, extradition to the Philippine government, and lifetime ban.

 

4. No blackmail, extortion and manipulation

One who threatens an individual with compromising or injurious information in exchange for something, or manipulate an individual against their will be liable to severe punishment.

 

Punishment: immediate deportation, extradition to the Philippine government, and lifetime ban. The offender may be required to pay monetarily for any damages they caused.

 

5. No fraud or framing

Those who use the means of deception for monetary or personal gains in the RAIS will not be tolerated within its borders. This includes the fabrication of information for diplomatic gain, the use of different identities without the knowledge of the government, and scamming.

​

Punishment: immediate deportation, (possible extradition to the Philippine government,) and lifetime ban.

​

6. No destruction of property

Acts of arson and vandalism will be punished depending on the offender’s intentions and the damage caused.

 

Punishment: for accidental destruction of property, 2 official warnings will be issued. If the property destroyed or damage is of considerable value to the RAIS, offenders of accidental destruction may be issued a limited ban or be immediately deported without a ban. Punishments for further offenses will be the same as the ones for intentional destruction.

 

Punishment for intentional destruction is immediate deportation and 1 month ban; and immediate deportation and indefinite ban for further attempts. Offenders who intentionally destroy property of considerable value to the RAIS will be immediately deported and indefinitely banned.

 

Acts under this charge of tremendous scale may lead to extradition to the Philippine government.

 

7. No revolting without cause

Unprovoked armed revolt against the government without cause (i.e. no “voice” declaring a reason or without attempting all available diplomatic or political solutions to reach an announced sensible goal) with lethal weapons will be treated as terrorism by the state and its people. Protests, rallies, and cyberwar will not generally count as revolts: the latter may be counted as a violation of basic human rights or even treason, however.

​

Punishment: 1 official warning for more lenient cases; otherwise immediate detainment, deportation, and a 1 month ban; and indefinite ban for further offences.

 

8. No child abuse

The act of abusing children (physically and for monetary or personal gains) will not be tolerated in the RAIS, whether it be by force or manipulation. Children with full knowledge and acceptance of their abuse will be considered manipulated and be subject to their right of welfare. Child pornography falls under this act.

 

​Punishment: immediate deportation, extradition to the Philippine government, and indefinite ban. For child pornography or any material of such nature will be destroyed on sight.

​

9. No animal abuse

Animals have their own version of the right to welfare, and are not to be subjected to any form of abuse or unprovoked acts of violence. Animals will also specifically have the right to food and water, shelter, and attention.

 

Punishment: immediate deportation, extradition to the Philippine government, and indefinite ban.

 

10. No environmental destruction

The surroundings of the RAIS shall be treated with respect and not abused. Littering, squatting, deforestation (in any territory that applies), and water pollution fall under this subject.

 

Punishment: 1 official warning; immediate deportation for second offence; immediate deportation and 1 month ban for third offence; deportation and indefinite ban for further offences.

 

11. No illegal weapons/weapons irresponsibility

Unlicensed weapons (specifically firearms) are illegal within the borders of the RAIS; any weapons not banned under any circumstances but unlicensed under the ownership of any RAISian will be given a grace period of 3 days to register their weapon. For visitors, only licensed lethal weapons may be brought in with a permit from their country with the requirement that they submit to the supervision of the RAIS government during their stay in the republic. Weapons that may NOT be brought in under any circumstances include nuclear, chemical, biological, or any weapons deemed “unstable” by the state.

 

Irresponsible weapon management (such as the disregard for the 4 golden rules of firearms handling) also falls under this category, and may be liable to punishment.

 

Punishment: immediate deportation (of weapons as well), extradition to the Philippine government, and indefinite ban.

12. No neglecting of duties/corruption and incompetence

Individuals who neglect their duties as citizens, soldiers, and workers of the state may face punishment. This includes feigning ignorance or engaging in actual ignorance when one is in need of assistance; neglecting safety procedures or engaging in shoddy behavior that may result in the endangerment of fellow citizens, comrades, or workers; giving in to money, favors, or other activities (especially if for personal gain) in exchange for abandoning their assignments or post; betraying their country directly whether in peace or war; and the like. Treason falls under this category.

 

​For those in more senior positions, they may be convicted by the populace or impeached.

 

​Punishment: immediate deportation and indefinite ban.

​

​

5. Social Code (Lav’Yandi’d’Mnudepina) of the RAIS

​

1. You're not to think you are anything special.

 

2. You're not to think you are as good as we are.

 

3. You're not to think you are smarter than we are.

 

4. You're not to imagine yourself better than we are.

 

5. You're not to think you know more than we do.

 

6. You're not to think you are more important than we are.

 

7. You're not to think you are good at anything.

 

8. You're not to laugh at us.

 

9. You're not to think anyone cares about you.

 

10. You're not to think you can teach us anything.

 

11. Perhaps you don't think we know a few things about you?

​

6. Military Constitution of the RAIS

​

The military constitution decrees that the armed forces of the RAIS shall:

 

1. Be a compact, mobile, multipurpose, and tactical force

RAIS doctrine relies on its military to be a disciplined fighting force that is quick, agile, and ready to move, emphasizing on the state’s small defence arsenal and size. The military shall hereby rely on force multipliers, such as good equipment, decent training, skillful directorship, and coordination.

​

Because of its size, the RAIS Defence Corps will be unable to put up a big fight or engage in conventional warfare; thus, RAIS military doctrine concludes that the military would be more effective with guerrilla tactics as its main set guidelines for warfare, as well as psychological tactics, cyber warfare and electronic warfare. RAIS doctrine also emphasizes on saving as much resources as possible.

​

Furthermore, the doctrine calls for the RAIS Defence Corps to be multipurpose; because of the RAIS’ status as a stratocracy, it is classified as a militia unit in peacetime, and as a full-fledged military force in wartime. Regardless of the state of the time, the corps will also act as law enforcement, special forces, and national intelligence (as well as the overall emergency response service).

 

Military service is compulsory for ages 18 to 21; one must at least serve 6 months and complete basic training.

 

2. Be a non-interventionist force

The RAIS shall not intervene in any other state or entity’s affairs without consent, and even then shall only intervene if necessary and after great consideration with the agreement of both the president and the Plinmuszig. This includes the lending of assets which can be used for offensive acts.

 

However, this policy may be disregarded when considering mutual defence pacts, albeit when agreeing to such pacts, the process for state intervention shall apply as well.

​

3. Operate according to the Geneva Convention laws

The RAIS and its armed forces officially recognize the rules of war as defined by the Geneva Conventions. Therefore, the state and its security forces will abide by them, no matter the circumstances.

​

4. Have the president as the military chief

As a stratocracy, the national leader shall also be the chief (hence the position of president-chief). However, the positions of president and chief may be separated in special circumstances, with the president becoming commander-in-chief, should this happen. Regardless of this, the president shall have the final say in deciding orders for the military, with the consultation of the Plinmuszig and the heads of the military departments (essentially also members of the parliament).

​

5. Use force as needed, but only as a last resort and for self-defence.

Full or partial military or “police” force shall be deployed only as last resorts (in self-defence, and for self-defence only), as the RAIS shall uphold negotiation and diplomacy as its main method of dealing with or preventing conflicts. However, force may be applied in situations where it may quickly diffuse or neutralize conflicts with minimal casualties.

 

A similar policy shall apply in dealing with smaller situations, such as hostage-taking, small-scale terrorism, or interrogation.

​

6. Apply subtle show of might when possible, and save intimidation tactics before force.

The pride of the military is as important as its humbleness. In some situations, it is important to show the capability of the RAIS’ armed forces as a means of boosting morale. However, it is important when to know the time to do this, and to practice moderation as well.

​

Showing the efficiency of the RAIS Defence Corps may act as a good intimidation tactic, especially as a last resort before switching to force.

 

7. Not tolerate defectors and deserters

Defectors and deserters will not be tolerated. Aside from obvious acts of betrayal, the act of defecting or deserting will be treated as treason. Additionally, while mutinies are acceptable in some cases, orders are to be always obeyed when without justified cause to resist, and their results, whether intended or disastrous, will be the responsibility of the deciding superior. In the very least, soldiers are to remain in their posts or unit, or remain enlisted until they are dishonorably or honorably discharged.

​

8. Only be able to carry out martial law under orders from the Plinmuszig and president-chief, when there is a state of emergency

As the state is a stratocracy, this would also count as nationwide mobilization. It would only be martial law for visitors and citizens unqualified (disabled or elderly) to be soldiers. In theory, a state of emergency would be called during times of armed conflict, such as war or terrorism.

​

9. Have the AMIA exempt from all the above

The RAIS recognizes that the AMIA and most of its operations are done for the sake of the RAIS’ security interests, and thus is vital to national security. The AMIA can only be of crucial use if it is unrestricted by military constitution.

7. Foreign Policy and Diplomacy of the RAIS

​

1. The RAIS shall be officially neutral and non-aligned, but not necessarily hostile.

​

Accordingly to its state-sanctioned ideologies, it shall not provoke nor court close political partnerships with other entities, and rely mostly on neutral but candid diplomacy. However, it can (and it is encouraged to) maintain amiable ties with other entities to ensure a harmonious existence and even gain mutual benefit with them (such as from cooperation during times of crisis).

 

The RAIS is eligible for trading, and other economic and scientific ventures, and may be open for military drills and events regarding emergency response to natural calamities, disaster, and terrorism.

​

2. The state shall practice a limited but effective form of isolationism.

​

While the state must maintain open routes for trade, diplomacy, and supplies, it shall continue isolating itself from the influence of other entities and primarily attend to its own affairs. This is so to limit energy and financial expenditures, as well as to preserve the political environment, culture, and national identity (specifically, from strong outside influences that may overwhelm the republic).

​

Of course, the state shall also practice moderation, and balance its isolation via “limited” interaction with the world.

​

3. In every diplomatic proceeding, RAIS representatives and diplomats must always consider and apply the values of their state.

​

In diplomacy, RAIS representatives and diplomats must always consider the LYM and the RAIS’ other values, and apply these to decisions to be made at hand, when possible. The RAIS shall not and will not accede to decision by manipulative forces, veiled threats, or peer pressure.

​

Additionally, RAIS officials must always strive to choose which diplomatic path shall be the best in preserving the RAIS’ ways of life, and which will be good for the state in the long term run. Ultimately, the RAIS shall put the welfare of the state and society before other nation’s or party’s interests, reflecting on the core meaning of the RAIS values.

​

4. The micronation has the right to accept NO REFUGEES from war torn areas or fleeing their countries illegally.

​

Legal immigrants with an education (and even a degree), who can speak English may be eligible for citizenship if they pass the citizenship requirements.

​

5. RAISian citizen requirements:

  • The RAIS grants two kinds of citizenships:

  • Actual citizenship, specifically for those planning to reside in the RAIS (albeit those living abroad are still eligible, but will be treated as expatriates).

  • Honorary citizenship, for those who have had positive history with the RAIS, or simply achieved something great in the republic's eyes. (Note that this sort of citizenship is awarded and not requested).

One may only be a RAISian citizen if they:

  1. Are close historical affiliates of the RAIS, and share much in common with the interests of the state, invited to citizenship, or apply for citizenship whenever the RAIS opens itself to citizenship applications

  2. Submit their birth details, proof of a high school diploma, and a recent ID or 1x1 photo of themselves

  3. Pass a security examination

  4. Pass a citizen examination

  5. Read and accept the constitution

  6. Sing the national anthem and swear to the oath of allegiance - both in front of the RAISian flag and the head of state

  7. Cooperate in basic RAISian service training, if they are aged 18 to 21, and afterwards agree to life as a soldier of the state, whether in active or reserve service

 

​RAISian citizens will be presented with a certificate of citizenship with their details, and a small RAIS flag pin from the government, once they fulfill all the requirements and become a citizen.

​​

6. Visitors, with the exemption of some VIPs (diplomats, guests, etc. who are waived or invited by the government) will need a verbal permit and signature to enter the RAIS.

​

Individuals in the RAIS may be subjected to signing the logbook and providing a date stamp of their arrival. (Presentation of passport is appreciated but not required at the moment). The grace period for visitors staying in the RAIS is 24 hours, before getting fined or kicked out for trespassing.

​

​

III. Afterword

​

All rights to the AMC belong to the current PC or their successor: should the RAIS fall, they shall be passed on to its next reincarnation (requiring the ownership of two of the state’s first physical flags, the old Tolmakian flag, and the government stamp). Should a reincarnation fail to materialize within 10 years, then they shall all be null and void in an instant.

As of 2024, recent internal policy may also not be directly reflected by the AMC due to ongoing changes.
